Modifică în parte sentinţa civilă recurată în sensul că :
Admite excepţia lipsei calităţii procesuale pasive a D.G.F.P. Neamţ în numele şi pentru M.F.P. P.Neamţ şi în consecinţă respinge acţiunea faţă de această parte pentru lipsă calitate procesuală pasivă.
Respinge şi pentru anul 2010 acţiunea ca nefondată.
Menţine dispoziţia de respingere a acţiunii pentru anii 2011, 2012 şi pentru viitor.
