În baza art. 385/15 pct. 2 lit. d Cod procedură penală;
Admite recursul formulat de S.C. E.ON GAZ DISTRIBUŢIE S.A. cu sediul în Tg. Mureş împotriva încheierii penale din 17 mai 2013 a Judecătoriei Bacău, pronunţată în dosar nr. 7760/180/2012 pe care o casează cu privire la instituirea măsurii asigurătorii a sechestrului.
Reţine cauza spre rejudecare şi pe fond.
Respinge cererea formulată de părţile vătămate privind instituirea măsurii asiguratorii a sechestrului asupra imobilului situat în Bacău, str. N. Titulescu nr. 34, proprietatea S.C. E.ON GAZ DISTRIBUŢIE S.A.
Menţine celelalte dispoziţii ale încheierii recurate.
Cheltuielile judiciare, în recurs, rămân în sarcina statului.
Definitivă.
