Admis apel
Admite apelul declarat de partea vătămată Derscariu Dumitru împotriva sentinţei penale nr.37 din data de 22.01.2014 pronunţată de Judecătoria Rădăuţi în dosar nr. 2021/285/2013.
Desfiinţează în parte sentinţa penală mai sus-menţionată, relativ la latura civilă a cauzei, numai în ceea ce priveşte partea vătămată apelantă şi trimite cauza spre rejudecare, în aceste limite, aceleiaşi instanţe.
Menţine celelalte dispoziţii ale sentinţei care nu sunt contrare prezentei decizii.
Cheltuielile judiciare din apel rămân în sarcina statului, din care suma de 600 lei reprezentând onorariu avocaţi oficiu inculpaţi intimaţi se va avansa din fondurile Ministerului Justiţiei către Baroul Suceava.
Definitivă.
