Schimbat în parte
Admite în parte apelurile declarate de reclamanţii Lazăr Augustin ş.a. şi de pârâtul Parchetul de pe lângă Curtea de Apel Cluj împotriva sentinţei civile nr. 5761 din 17.10.2014 pronunţată de Tribunalul Cluj în dosarul nr. 1581/117/2014, pe care o schimbă în partea în sensul că dobânda legală la care au fost obligaţi pârâţii, calculată în temeiul O.G. nr. 13/2011, este dobânda legală penalizatoare.
Admite excepţia lipsei calităţii procesuale pasive invocată de pârâtul Parchetul de pe lângă Curtea de Apel Cluj şi în consecinţă respinge acţiunea formulată de reclamanţi, cu excepţia reclamantului Nariţa Ilie, în contradictoriu cu acest pârât.
Păstrează restul dispoziţiilor sentinţei atacate.
Respinge ca nefondate apelurile declarate de pârâţii MP - Parchetul de pe lângă ÎCCJ – DNA, Parchetul de pe lângă Tribunalul Alba, Parchetul de pe lângă Curtea de Apel Alba-Iulia, MP – Parchetul de pe lângă ÎCCJ-DIICOT şi MP – Parchetul de pe lângă ÎCCJ, împotriva aceleiaşi sentinţe.
Definitivă.
