Schimbat în parte
Admite în parte apelul declarat de pârâţii MP – PCA Cluj şi PT Cluj împotriva sentinţei civile nr. 4176 din 23.12.2015 pronunţată de Tribunalul Cluj în dosarul nr. 1500/117/2014, pe care o schimbă în parte în sensul că:
Înlătură dispoziţia de obligare a pârâţilor la plata daunelor moratorii sub forma dobânzii legale prevăzută de O.G. nr. 9/2000 şi a dobânzii penalizatoare prevăzută de O.G. nr. 13/2011 prin raportare la menţiunile cuprinse în titlul executoriu Sentinţa civilă nr. 910/28.05.2008 pronunţată de Tribunalul Călăraşi în dosarul nr. 394/116/2008.
Păstrează restul dispoziţiilor sentinţei atacate.
Respinge ca nefondate apelurile declarate de pârâţii MP-PÎCCJ şi MP-PÎCCJ-DIICOT împotriva aceleiaşi sentinţe.
Definitivă.
