Legea 85/2006 privind insolventa
Respinge, ca neîntemeiată, cererea formulată de R.&P. SPRL - în calitate de lichidator judiciar provizoriu al debitoarei S. S.&C. SRL şi având ca obiect completarea dispozitivului sentinţei civile nr. 619/01.11.2016 pronunţată de Tribunalul Bistriţa-Năsăud în dosarul nr. 6512/112/2012/a84 - cerere soluţionată în contradictoriu cu contestatoarea creditoare S. B.T. SA, debitoarea S. S.&C. SRL reprezentată de U. SPRL, având calitatea de actual lichidator judiciar, şi cu toţi ceilalţi creditori care au fost citaţi prin BPI. Cu drept de recurs în termen de 07 zile de la publicarea în BPI a prezentei hotărâri. Recursul se depune la Tribunalul Bistriţa-Năsăud. Dată în camera de consiliu şi pronunţată în şedinţa publică din data de 16.12.2016.

Respinge excepţia tardivităţii contestaţiei în ceea ce priveşte solicitarea de constatare a nelegalităţii convocării adunării generale a creditorilor, invocată de creditorii S. R. SRL şi S.T. Respinge contestaţia formulată de creditoarea S. B.T. SA., soluţionată în contradictoriu cu RTZ & P. SPRL în calitate de lichidator judiciar provizoriu al debitoarei S. S.&C. SRL şi toţi creditorii, citaţi prin BPI, sens în care : Menţine în fiinţă Hotărârea adoptată de Adunarea generală a creditorilor debitoarei S. S.&C. SRL la data de 24.08.2016 în dosarul 6512/112/2012 a Tribunalului Bistriţa-Năsăud şi pe cale de consecinţă, pe de o parte, numeşte în calitate de lichidator judiciar al debitoarei S. S.&C. SRL pe practicianul în insolvenţă desemnat de către creditori prin hotărârea mai sus menţionată, respectiv pe SCPI U. SPRL şi, pe de altă parte, constată încetarea calităţii de lichidator judiciar provizoriu a RTZ & P. SPRL. Definitivă şi executorie. Cu drept de recurs în termen de 07 zile de la publicarea în BPI a prezentei hotărâri. Recursul se depune la Tribunalul Bistriţa-Năsăud. Dată în camera de consiliu şi pronunţată în şedinţa publică din data de 01.11.2016.
