Respinge recursul principal ca nefondat. Admite recursul incident. Casează în parte sentinţa civilă recurată şi rejudecând: Admite excepţia lipsei calităţii procesuale pasive a pârâtului MAI. Respinge acţiunea formulată în contradictoriu cu pârâtul MAI ca fiind formulată împotriva unei persoane lipsite de calitate procesuală pasivă. Menţine, în rest, sentinţa civilă recurată. Definitivă.
