Schimbat în parte
Admite apelul declarat împotriva sentinţei 402/2017 a Tribunalului Neamţ. Schimbă, în parte, sentinţa în sensul că:
Obligaţia de plată constă în diferenţa rezultată din neacordarea reclamanţilor a sumelor compensatorii reprezentând solda de merit în perioada 9 apr.2015 - 31 iulie 2017 ţinând cont de faptul că în perioada 1 august 2016 - 31 iulie 2017 această diferenţă, a fost acordată în parte în procent de 50% din cuantumul sumei compensatorii corespunzătoare soldei de merit, în plată, la nivelul anului 2009, conform art.3 ind.1 alin.5 din O.U.G. 57/2015, astfel cum a fost modificată prin O.U.G. 20/2016.
Menţine din sentinţă dispoziţiile care nu sunt contrare prezentei decizii. Respinge apelul formulat împotriva încheierii din data de 3 mai 2017 de respingere a cererii de lămurire dispozitiv.
Definitivă.
