Admite in parte cererea
Admite în parte acţiunea precizată.
Obligă pârâtul APIA - Centrul Judeţean Argeş să stabilească drepturile salariale ale reclamantei conform art.1 alin.5 ind.1 din OUG nr.83/2014, aprobată prin Legea nr.71/2015 şi să-i plătească diferenţele salariale rezultate, începând cu data de 01.01.2016 şi până la data de 31.07.2016.
Obligă pârâtul la 5500 lei cheltuieli de judecată către reclamantă.

Amână cauza
Dispune disjungerea cererilor formulate de reclamanţi, urmând ca instanţa să rămână învestită în prezentul dosar cu cererea formulată de Sindicatul Naţional APIA, în numele şi pentru Drăgulinescu Andreea, şi constituirea de dosare distincte pentru fiecare dintre ceilalţi reclamanţi, ce vor fi repartizate aceluiaşi complet, respectiv C5, în temeiul art.111 alin.4 din HG nr.1375/2015.
Stabileşte termen de judecată după cum urmează: la data de 26 octombrie 2018 în dosarele privind pe primii 35 de reclamanţi, la data de 09 noiembrie 2018 în dosarele privind pe următorii 36 de reclamanţi şi la data de 26 octombrie 2018 în prezentul dosar, pentru când se vor cita părţile din fiecare dosar.
Pronunţată în şedinţă publică astăzi, 28 septembrie 2018.
