Schimbat în parte
Respinge ca nefondat apelul declarat de reclamanţi.
Admite apelul declarat de pârâta Compania Naţională de Căi Ferate CFR S.A. Bucureşti, prin Sucursala Regională CF Iaşi.
Schimbă în parte sentinţa civilă nr. 1151 din 1.10.2018 a Tribunalului Suceava, pronunţată în dosar nr. 941/86/2018, în sensul că:
Respinge ca nefondat capătul de cerere vizând obligarea pârâtei să plătească fiecărui reclamant, drepturile băneşti cu titlu de plată ore suplimentare pentru activitatea prestată cu depăşirea programului normal de 8 ore pe zi, cu un spor de 95% pentru orele suplimentare efectuate în timpul săptămânii şi cu un spor de 100% pentru orele suplimentare prestate în perioada repaosului săptămânal sau a sărbătorilor legale, pe perioada valabilităţii Contractului colectiv de muncă la nivel de unitate 2017 – 2018.
Menţine celelalte dispoziţii ale sentinţei civile atacate care nu sunt contrare prezentei decizii.
Obligă reclamanţii în solidar să plătească pârâtei Compania Naţională de Căi Ferate CFR S.A. Bucureşti suma de 127 lei cu titlu de cheltuieli de judecată din apel.
Definitivă.
