Respinge ca neîntemeiată excepţia tardivităţii formulării contestaţiei, invocată de lichidatorul judiciar CC Insolv SPRL al debitoarei Miniera Medgidia SA.
Admite contestaţia formulată de contestatorul Tonescu Finance SaRL.
Dispune desfiinţarea raportului de activitate întocmit de lichidatorul judiciar pentru perioada cuprinsă între 01.10.2019-03.12.2009, publicat în BPI nr. 23407/09.12.2009, sub aspectul măsurii privind plata parţială a cheltuielilor de procedură înregistrate cu paza.
Obligă lichidatorul judiciar la refacerea raportului, ca urmare a constatării nelegalităţii măsurii privind achitarea cheltuielilor de procedură înregistrate cu paza şi cu respectarea dispoziţiilor art. 21 alin. 1 ind. 1 din Legea nr. 85/2006.
Cu recurs în 7 zile de la comunicare.
