Admite cererea
Respinge excepţia prescripţiei dreptului material la acţiune.
Admite contestaţia îndreptată împotriva tabelului preliminar al creanţelor cu privire la debitoarea DIVERGENT OPTIM SRL, formulată de contestatoarea FAIR APARTMENTS SRL, în contradictoriu cu intimaţii CII SUT LORICA ILEANA, DIVERGENT OPTIM SRL.
Dispune înscrierea în tabelul preliminar al creanţelor cu privire la debitoarea DIVERGENT OPTIM SRL, a creanţei creditoarei FAIR APARTMENTS SRL în cuantum de 108 840,72 lei.
Obligă intimatul CII SUT LORICA ILEANA să plătească contestatorului suma de 5978,64 lei, cu titlu de cheltuieli de judecată.
Cu drept de apel în şapte zile de la publicare în BPI, cererea de apel se va depune la Tribunalul Bistriţa-Năsăud.
