Respinge, ca nefondat, apelul declarat de pârâtul Tribunalul Bucureşti.Admite apelul declarat de pârâtul Ministerul Justiţiei. Schimbă în parte sentinţa apelată, în sensul că admite excepţia lipsei calităţii procesuale pasive a Ministerului Justiţiei. Respinge acţiunea formulată împotriva Ministerului Justiţiei ca fiind promovată în contradictoriu cu o persoană fără calitate procesuală pasivă.Menţine restul dispoziţiilor sentinţei. Definitivă.
