Trimitere cu rejudecare
Admite recursul.
Casează în parte sentinţa recurată în ce priveşte acordarea sporului de fidelitate, şi în rejudecarea acestei cereri, obligă pârâtul să stabilească drepturi salariale conform dispoziţiilor art. 1 alin. 5.1 din OUG nr. 83/2014, aprobată prin Legea nr. 71/2015, ale art. 3.1 alin. 1 din OUG nr. 57/2015, modificată/completată prin OUG nr. 20/2016 şi, respectiv, ale art. 3 alin. 1 din OUG nr. 99/2016, cu reţinerea salariilor de funcţie acordate la momentul respectiv pentru funcţii similare, salarii ce includeau şi compensaţia corespondentă sporului de fidelitate cu luarea în considerare a treptelor de vechime.
Menţine celelalte dispoziţii ale hotărârii care nu contravin prezentei.
Definitivă.
