Amână cauza
Recalifică calea de atac din apel în recurs, având în vedere că hotărârea atacată a fost pronuntată într-un dosar de insolventă din anul 2012, fiind astfel incidente prevederile Legii nr. 85/2006 în forma existentă anterior modificărilor survenite prin Legea nr. 76/2012, prevederi care reglementau calea de atac a recursului împotriva tuturor hotărârilor judecătoresti pronuntate de judecătorul sindic.
În baza prevederilor art. 143 alin. 2 si 4 din Regulamentul de Ordine Interioară al Instantelor Judecătoresti trimite recursul spre repartizare aleatorie între completele de recurs.
