Schimbat în parte
Respinge apelul formulat de reclamanţii – apelanţi ca nefondat.
Admite apelul formulat de pârâta – apelantă Şcoala Gimnazială nr. 1 Cristeşti.
Schimbă în parte hotărârea atacată, în sensul că:
Obligă pârâtul să calculeze şi să achite membrilor de sindicat reprezentaţi în dosar, după caz, eventualele diferenţe de drepturi salariale decurgând din acordarea majorărilor/creşterilor salariale pentru pentru funcţia de diriginte/învăţător/eductoare/institutor/profesor pentru învăţământul primar/profesor pentru învăţământul preşcolar, pentru gradaţia de merit şi pentru predare simultană, conform situaţiei personale de încadrare începând cu data de 01.01.2019 (cuprins în diferenţele de drepturi rezultate prin aplicarea art. 38 alin. 41 din Legea nr. 153/2017) şi până la 31.05.2021, drepturi ce vor fi actualizate în funcţie de coeficientul de inflaţie la care se adaugă dobânda legală penalizatoare aferentă, până la data plăţii efective.
Menţine celelalte dispoziţii care nu sunt contrare prezentei hotărâri.
Definitivă.
Pronunţată prin punerea soluţiei la dispoziţia părţilor prin mijlocirea grefei, azi, 20.09.2022.
