Admite atât apelul declarat de apelanta-debitoare Centrala Electrică de Termoficare Arad SA (C.E.T. Arad) prin lichidator judiciar provizoriu Eurosmart Filiala Timiş SPRL, cât şi apelul declarat de apelanta-creditoare A*** E***** R****** S*, în contradictoriu cu intimata-creditoare Gas & Power Trading SRL şi cu creditorii debitoarei, împotriva sentinţei civile nr. 627 din data de 09.09.2022, pronunţată de Tribunalul Arad, în dosarul nr. 1377/108/2018, având ca obiect cerere de intrare în faliment a debitoarei.
Schimbă în tot sentinţa atacată în sensul că respinge cererea de deschidere a procedurii de faliment a societăţii CET Arad SA, formulată de Distrigaz Vest SA, însuşită de cesionara Gas&Power Trading SRL.
Definitivă.
Pronunţată la data de 28.11.2022, prin punerea soluţiei la dispoziţia părţilor, prin mijlocirea grefei instanţei.
