Respinge recursurile formulate de Banca Transilvania SA, Eurobank SA şi ERB New Funding, ca nefondate.Admite recursul formulat de recurenţii reclamanţi. Casează în parte decizia recurată şi trimite cauza aceleiaşi instanţe spre rejudecarea apelului formulat de reclamanţi cât priveşte capetele de cerere referitoare la constatarea caracterului abuziv al clauzelor privind comisionul de acordare, comisiponul de administrare şi restituirea sumelor încasate în baza clauzelor criticate, inclusiv a sumelor pretinse cu titlu de dobânda excedentară.
