Admite recursul formulat de recurenta pârâtă DGRFP Gala?i împotriva sentin?ei nr. 178/FCA/04.05.2022 pronun?ată de Tribunalul Brăila - Sec?ia a II a Civilă ?i de Contencios administrativ ?i fiscal.
Casează în parte sentin?a recurată ?i, în rejudecare, respinge atât capătul principal de cerere vizând acordarea în integralitate a majorării salariate de 25%, prevăzută de art. 38 alin. 3 din Legea 153/2017, începând cu 01.01.2018, cât ?i capetele de cerere accesorii ale acestei preten?ii vizând actualizarea sumelor cu indicele de infla?ie ?i obligarea pârâtei la plata dobânzii legale, ca nefondate.
De asemenea respinge ?i capătul de cerere vizând obligarea pârâtei la plata cheltuielilor de judecată.
Men?ine sentin?a recurată cu privire la solu?ia pronun?ată asupra celorlalte preten?ii formulate.
