Dec. 423- Admite apelul declarat de reclamanţi, reprezentaţi convenţional de reclamantul S****** I**** C***** împotriva sentinţei civile nr.86/04.03.2022 a Tribunalului Vrancea.
Schimbă în tot sentinţa apelată şi în rejudecare:
Admite acţiunea formulată de reclamanţi.
Obligă pârâtul Spitalul Judeţean de Urgenţă „Sfântul Pantelimon” Focşani să stabilească salariile de bază ale reclamanţilor începând cu data de 01.01.2019, în conformitate cu Anexa nr.VII din Legea nr.153/2017, cu respectarea dispoziţiilor art.38 alin.6 din aceeaşi lege.
Obligă pârâtul să plătească reclamanţilor începând cu data de 01.01.2019 diferenţele salariale dintre drepturile salariale acordate şi cele cuvenite raportat la calculul salariului de bază pentru funcţiile TESA deţinute de reclamanţi, în conformitate cu Anexa VII din Legea nr.153/2017, sume ce vor fi actualizate cu indicele inflaţiei la data plăţii efective.
Definitivă.
Pronunţată prin punerea soluţiei la dispoziţia părţilor prin grefa instanţei azi, 30.05.2022.
